Terms and Conditions

Welcome to ChinaitechPay, a virtual currency exchange service available to you through ChinaitechPay.finance website, physical offices or other means (the “Service”).

 

By using the Service, you agree to these Terms, along with our policies including Privacy Notice, Cookie Policy, AML/CFT Policy, that represent the entire agreement between you (or “user”) and Business registration number BN434810524, registered at Accra Greater Region - Ghana and 1 Office in United Kingdom, Business license P0062680032 (referred to as «ChinaitechPay», "we", "us", or "our").

 

If you disagree with any of these Terms, please refrain from using the Service.

 

In an exchange with PayPal or any options

For new customers, we conduct a comprehensive verification process (requiring proof of ownership and other relevant data) before initiating payments on the exchange. Typically, payment delays are implemented as follows:

  • Payment Processing time: 10 to 60 minutes at the amounts less than 10 to 500 USD

 

  • 6-72 hours at the amounts less than 1,000 to 10,000 USD

  • PayPal Payment: We accepts payments both "Goods and Services" and "Friends and Family" you can choose to send payment via any of these options.

  • We can facilitate the payment of "Goods and Services" via PayPal. Additionally, we can assist you in making online purchases through any website that accepts PayPal as a payment method.

 

The precise time of exchange is reported promptly after the submission of your exchange request exclusively on our website. In exceptional circumstances, we may substantially reduce the delay period when compelling reasons warrant it.

 

The exchange term for PayPal payments originating from countries with disabled personal payments (such as Kazakhstan) may be reasonably extended by our discretion.

 

In the exchange from cryptocurrencies

The initial rate is automatically updated upon the client’s view of the request. Subsequently, it is finalized either when the transaction is added to the mempool or upon the receipt of the first network confirmation. (A favorable rate is selected, so we advise against setting a low commission, as this may result in the transaction being held in the mempool for an extended period.)

We do not accept the funds from Bitget, CommEX, Coinbase, Kucoin, Garantex or Smart Contract, and if the funds are sent, it will be a possible total loss.
In the exchange to cryptocurrencies

The preliminary rate is updated automatically when the client views the request, and then it is fixed if the payment is received or the exchange request is changed (a favorable rate for us is chosen, so do not delay the notification of the payment made).

 

Please do not use the address of the accounts in Bybit and OKX, as these exchanges have had cases of blocking transfers from exchanger services


We do not divide money on gambling/non-gambling/forex etc. Therefore, if you need funds for exactly on gambling/non-gambling/forex etc., then, unfortunately, we cannot give any guarantees. Exchange can be made, but at your own risk.

 

All exchanges

If it's necessary, including at your own discretion, we can both accept and send funds in parts using multiple accounts.

 

When sending your payment you pay a sender`s commission, and a commission of the recipient is for us.
When we send a payment, we pay a sender`s commission, and a commission of the recipient is for you.

 

By accessing or using the Service, you confirm that:

  • You've read, understood, and fully accept these Terms.
  • You are at least 18 years old, or another age of majority at your place of residence.
  • You are eligible to enter into this agreement and use the Service.
  • You have the authority to bind any business or entity on whose behalf you use the Service, and that business or entity accepts these Terms.
  • You comply with these Terms and all applicable laws and regulations.

To utilise specific features of the Service, you need to register an account (“Account”). Registration requires a name, verified email address and a password. 

 

You are entitled to have only one Account at the Service. In case you register multi-accounts in violation of this clause, ChinaitechPay is entitled to terminate your Accounts and charge a full amount of funds from the balances as a penalty.

 

Account security

  1. When maintaining your Account you are responsible for:
  2. Ensuring the information provided is up-to-date, accurate, and precise.
  3. Informing us if there is any error, mistake, update, or change in information or documents you have previously submitted.
  4. Not sharing or transferring your Account login information to any third party.
  5. Safeguarding your login details and maintaining Account security.
  6. Not using your Account for any illegal purposes and activities.

 

If you believe your Account has been accessed without your permission or if your login details are compromised in any way, contact us immediately.

 

We reserve the right to suspend or terminate the Account, if we reasonably believe it is used by a person other than the one in whose name it was registered.

 

Services

ChinaitechPay services include online and offline virtual currency exchanges between virtual and fiat currencies and operations with virtual currency wallets.

 

  • You may be required to pass the KYC/KYB/AML check required by law.
  • We may charge you with the fees for the transactions.
  • Virtual currency transactions are nonrefundable.

ChinaitechPay services provided to users via the Service involve:

  1. Exhange of the decentralised digital assets (“virtual currency”) to fiat currency; 
  2. Exhange of the virtual currency to other virtual currency; 
  3. Exhange of the fiat currency to the virtual currency;
  4. Operations with virtual currency wallets.

 

The exchanges are available online via ChinaitechPay.com website, and offline at the ChinaitechPay physical offices or via couriers.

 

To provide the Service you authorise us to receive fiat and virtual currencies, temporary hold, exchange, and disburse them, as well as deduct the applicable fees and other costs on your behalf, and to take all actions that we find necessary or desirable to provide our services to you and to comply with any applicable law and these Terms.

 

Due diligence

In order to provide some services to you we are required by law to carry out all necessary security and customer due diligence checks on you and any parties involved in your transactions, if applicable. Due diligence checks are conducted by a third-party service provider in accordance with our AML/CFT Policy and Privacy Notice.

 

You agree to comply with any request from us for further information and provide such information in a format acceptable to us.

 

For exchanges via ChinaitechPay physical offices you agree to provide the originals of the documents, personal information and comply with other measures that may be required for due diligence checks and security purposes, as requested by the ChinaitechPay representative.

 

We reserve the right to refuse services to users that fail to pass the due diligence checks, as well as to the users residing in certain jurisdictions.

 

Supported currencies

The list of then-currently supported fiat and virtual currencies is available on the ChinaitechPay.com website and may be changed by ChinaitechPay from time to time without prior notice to you.

 

If you attempt to deposit virtual currency that we don't support, we may charge you a fee to cover our costs and expenses related to the identification and return of such virtual currency. Such fee may be withheld from the virtual currency that was the subject of the improper deposit attempt.

 

The exchange services related to some of the supported currencies (e.g. UAH, KZT) are provided by third parties.

 

Deposits and withdrawals

The deposit of funds to the Account shall be made by a transfer of funds to the payment details specified by ChinaitechPay. 

 

By depositing funds from, or withdrawing funds to, the financial account or wallet maintained outside the Service you confirm that:

  1. You own the funds legally;
  2. You are the beneficial owner of the account or wallet,
  3. You’re in compliance with all terms and conditions applicable to the account or wallet, 
  4. You have the authority to make deposits to the account or wallet and take withdrawals from the account or wallet, and 
  5. You have provided complete and accurate information to us regarding the account or wallet. 

 

We may request documentation to verify the source of funds before conducting the transactions. If you deposit the funds for exchange from a third-party account, such transaction may be blocked.

 

We may, at any time and without notice, reject any deposit or impose limits on deposits you can make.

 

The deposited funds will be available for transactions after we receive the necessary number of confirmations.

 

In case you deposit or withdraw the funds using third-party services, your transactions are subject to the terms and conditions of such third parties. You are solely responsible for the payment of all commissions and fees related to such transfers.

 

Exchange procedure

All exchanges are performed according to the user’s orders made in the appropriate form through the Service, including via external messengers. We may reject any exchange order or other transaction at our sole discretion, whether confirmed by you or not, and we aren’t liable to you for any rejection.

 

The exchange transaction is carried out after receiving funds from the user in full amount in accordance with the order submitted to ChinaitechPay. If the funds for exchange are not received within the time and to the account specified by ChinaitechPay in the order, the order is automatically cancelled. 

 

If the amount of received funds differs from the order or was transferred in several transactions, the exchange will not be made automatically. In some cases the exchange may be made manually with an additional service fee. Please contact our support team for more information.

 

ChinaitechPay completes the exchange within 1 business days, unless the user fails to transfer the full amount of funds or pass the KYC/AML check, or it is dependent on the virtual currency network transaction speed, or other circumstances outside our control. We are not responsible for delays in payment processing caused by banks or other financial institutions, or due to the blockchain network delays.

 

After this period you can request a refund if the exchange is not initiated by ChinaitechPay. A refund will be processed within 3 business days. In cases where the user fails to pass the KYC/AML check, the refund will be available upon the user's provision of the requested documents and may take up to 30 calendar days. 

 

The exchange is considered completed at the moment of crediting the funds to the payment details specified by you, or at the moment of passing the funds to you by the courier.

 

Exchange rate

We may utilise the spot exchange rate of the given trading pair that may vary and does not coincide with the rate on other exchanges, conversion services and market data providers. The exchange rate fluctuates in accordance with the market, therefore it is only valid for a limited time. The exchange rate for a specific transaction is fixed at the moment of receiving funds from the user, unless otherwise determined by ChinaitechPay.

 

Payment details

You are responsible for ensuring the accuracy of payment details (for example, the PayPal, Mobile Money wallet, Crypto wallet address) you provide for transactions within the Service. Make sure you do not send funds from a smart contract.

 

ChinaitechPay shall not be liable for the errors and mistakes made by you in the payment details, as well as in the choice of network (token standard).

 

If you specify invalid, wrong or blocked payment details, the exchange is terminated with no refund obligation of ChinaitechPay.

 

Please contact our support team, if you have any of the above troubles. In some cases the transactions may be conducted manually with an additional ChinaitechPay service fee of minimum 5 USDT and network commission applicable.

 

Transaction limits

We can impose daily, monthly, and annual transaction volume limits per Account. If you wish to make a transaction over the limit you may be required to provide additional information and documentation. To make changes to your individual limits, please contact our support team.

 

Please note, that cash transaction limits may apply in accordance with the requirements of the legislation of the location where the transaction occurs.

 

Prohibited activities

We can refuse or restrict our services to you, if you engage in any of the listed prohibited activities.

ChinaitechPay reserves the right to refuse its services, or to impose permanent or temporary restrictions on the use of the Service (suspend/terminate the Account, freeze assets, set limits on the services and transactions without any liability to you or any third parties), if you, or a person connected with you:

 

  • Fail to present the documents and data, requested by ChinaitechPay, which are necessary for complying with the diligence measures, or present false or contradictory data; 

 

  • Are suspected to perform transactions that might be related to money laundering, terrorist financing, fraud or other crimes and unlawful activities;

  

  • Are found in a sanction list, lives or is located or established in a country or territory which is subject to a sanction, or otherwise did not pass our due diligence checks;

 

  • Violate intellectual property rights of ChinaitechPay or any third party;
  • Defame, harass, abuse, threaten or defraud others, or collect, or attempt to collect, personal information about others without their consent;

 

  • Are in, under the control of, or a national or resident of any country where crypto assets transactions are explicitly prohibited, any unsupported country (e.g. the United States of America, including all US territories) in accordance with our AML/CFT Policy,

 

  • Conduct an activity that must be licensed without a proper authorization;

 

  • Engage in any of the following types of business activities: unregulated gambling and lottery, trade in weapons, drugs, toxic/radioactive materials, pyramid and investment schemes, credit and collection services.

This list is non-exhaustive. It is within ChinaitechPay sole discretion to determine whether an activity falls into one of these categories

 

Third-party websites and services

Some functions of the Service depend on third-party services which we do not control, therefore we cannot guarantee the uninterrupted operation of all features.

 

Some features of the Service are available in compatibility with third-party websites, services, tools, or content. We strive for seamless operation, but since we do not control these external services, we cannot guarantee uninterrupted functionality for all features.

 

The transactions within the Service may be conducted using the services of third parties (partners, financial institutions, etc.), including transactions with certain currencies (UAH, KZT). By initiating transactions through the Service, you grant us the right and instruction to transfer to such third parties your personal information and funds, necessary to perform the initiated transaction. 

 

Remember, when you access and use these third-party websites, services, tools, or content, their terms and privacy policies apply, and ChinaitechPay is not responsible for any losses, damages or other liabilities arising from your interactions with them. ChinaitechPay does not bear any responsibility for the actions of such third parties.

 

Risk disclosure

Investing in virtual assets is considered to be associated with certain risks. Please do your own research before making any decisions in respect of operations with virtual currency.

 

Due to the potential for losses, the investment in virtual currency is generally assumed to be high-risk. The key risks are:

  • You could lose all the money you invest due to high volatility of virtual assets.

 

  • The virtual currency market is largely unregulated, therefore you can lose money due to cyber-attacks or financial crime.

 

  • You may not be able to sell your investment when you want due to technology outages, cyber-attacks, and commingling of funds and other issues causing a delay.

 

  • Virtual currencies do not necessarily have a specific form of protection or regulation by any governmental body, which means that by exchanging crypto assets, you will not be able to enforce any guarantees or safeguards expected with regulated financial services.

 

You should do your own research before investing. ChinaitechPay does not and will not provide any investment advice or legal advice regarding your exchange. You acknowledge that only you are responsible for your decisions and actions performed within the Service.

 

Other terms

We reserve the right, at any time at our sole discretion, with prior notice to: modify, suspend or discontinue the Service, Content, features or services offered through the Service. You agree that we shall not be liable to you or to any third party should any of the foregoing occur with respect to the Service.

 

We may transfer our rights and obligations under these Terms to a third party without affecting your rights or our commitments.

We reserve the right, at any time at our sole discretion, to modify these Terms. In case of material changes affecting your use of the Service, we will notify you prior to the changes’ effective date. By continuing to use the Service, you agree to the updated version of these Terms.

 

If any provision of these Terms is determined to be unlawful, void or unenforceable, the remaining provisions of these Terms will continue to be fully valid and enforceable.

 

A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to the use of the Service to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

 

Electronic communications

  1. We will communicate with you through email and push-notifications. 
  2. Expect updates about the Service, these Terms, and details about your transactions.
  3. If you want to stop receiving promotional emails, follow the instructions in those messages.

 

By using the Service and providing us with your contact details, you agree to receive the electronic communications via email, messengers or push-notifications regarding, without limitation: 

  1. Email verification;
  2. Account login and security;
  3. Your use of the Service;
  4. Transactions conducted via the Service and their statuses;
  5. Updates of the Service and these Terms.

 

Some notifications can be adjusted in your Account settings.
